A MUNTINLUPA court declared as fake the land titles covering the Susana Heights Subdivision due to alleged anomalies, questionable acquisition and serious discrepancies.
Judge Pedro M. Sabundayo, Jr. overturned an earlier decision of Judge N. C. Perello, who ruled in favor of the Intercontinental Development Corp., owner and developer of Susana Heights.
ICDC admitted before the court that the land titles of the subdivision, TCT Nos. 111350, 111351 and 111352, were derived from the Original Certificate of Title 656.
The court, however, found evidence proving OCT 656 to be “fatally flawed, spurious and void.”
Judge Sabundayo cited ICDC’s failure to explain the serious discrepancy between the date in OCT 656 and the date in the LRA List of Decrees Issued.
The court also discovered irregularities in ICDC’s acquisition of the property when it presented a number of unexplained Deeds of Assignment but could not show even one Deed of Absolute Sale.
The judge said that the ICDC misled the court when it admitted that it acquired the property under a Deed of Assignment dated Aug. 21, 1981, but it submitted to the Registry of Deeds a different DA which is dated June 17, 1981.
ICDC has appealed the decision before the Court of Appeals.
