BCDA agrees to John Hay arbitration

State-run Bases Conversion and Development Authority agreed to settle the case with the SobrepeƱa-led Camp John Hay Development Corp. through arbitration.

BCDA president and chief executive Arnel Paciano Casanova said Monday the agency had submitted the issues of termination of the lease agreement and the collection of CJHDevCo’s debt for arbitration before the Philippine Dispute Resolution Center Inc.

“BCDA adheres to the rule of law. Since the court orders us to go into arbitration, we will abide by that. We welcome the arbitration proceedings as it will allow us to recover what is properly due to the government,” Casanova said.

Casanova, however, said arbitration did not mean BCDA would stop seeking redress from any unlawful business practice that had taken place in areas under its authority.

“BCDA remains steadfast in its commitment to promote a healthy business environment for the Filipino people. It remains faithful to its mandate, and it will not hesitate to pursue criminal and administrative actions against any person that is rendering its efforts nugatory. Criminal and administrative actions, to be sure, cannot be subject of arbitration,” Casanova said.

BCDA earlier filed estafa and malversation complaints against CJHDevCo before the Justice Department.
